Do you know that in an advertisement there are so many intellectual property elements in it such as sounds, images, paintings, map, sculpture, books magazine, trademark and other third-party images. To avoid being sued for damages and your advertisement being stop, it is important to do some checklist on IP issues:
- Names, images and identifying personal traits such as signature, voice, biography etc – please get written permission before using it;
- Named used must be as generic as possible e.g. Ali Muthu or Ah Kow
- Personal images – do you know that if you accidentally being filmed during the filming for commercial ad, you have the right to claim for damages? Unless the company filming it has put a disclaimer near it then you are not entitled to it
- Using other people car with special Registration No for advertising without permission may also be subjected to claim for damages.
- Building and private location for filming need written permission from the owner
- Props – For fashion advertisement make sure any association with luxury items do not come with cheap items and permission granted if using a branded prop with strong trademark
Respect other people properties. This may include their intellectual properties. Get a permission. These are some ethics to show respect and appreciates other human being.
